1.18 When placing an order the customer must ensure that their email address is entered correctly and their mail box is in full working order so they are able to recover confirmation emails that are sent once their order has been accepted. Backtothetoyz.co.uk is not responsible for emails being blocked by junk mail filters.
1.19 Contracts formed between you (the customer) and us (the website) will be governed according to English Law, and as such, disputes which occur shall be subject to the jurisdiction of the English courts.
1.20 Please ensure when purchasing items you are aware of the total purchase price. This amount will be confirmed to you on review your order page and on your confirmation email.
1.21 Published prices, specifications and services are subject to change without notice, and do not include carriage unless explicitly stated. Queries regarding pricing should be raised as soon as possible.

1.23 All products are subject to availability. If an order is placed and an item is not in stock then an email informing you of this will be sent and that item will be cancelled and refunded unless you have previously agreed for the item to be ordered and sent out when it arrives in stock.
Payment
1.24 The payment card will be debited immediately after the order is accepted by Paypal. Therefore if any item is subsequently cancelled a refund will then be credited back to your account. Backtothetoyz.co.uk is not responsible for bank refund delays as all banks differ in refund times.
1.25 backtothetoyz.co.uk accepts Paypal and all cards that they accept. All credit and charge card holders are subject to validation checks and authorization by the card issuer. If the issuer of your payment card refuses to authorize payment to us, we will not be liable for any delay or non-delivery. In addition, in the interests of preventing fraudulent use of credit, debit and charge cards a third party may also be instructed to complete checks. By ordering from the backtothetoyz.co.uk web site you consent to such checks being made. We may need to contact you by letter, telephone or email to verify details before we are able to process and dispatch your order or we may be unable to accept your order. Any information given may be disclosed to a registered Credit Reference Agency which may keep a record of the information such as Paypal. All information provided will be treated in accordance with the Data Protection Act 1998
1.26 We reserve the right to refuse an order. Such refusal may arise from, but is not limited to, the following situations
(a) The item requested is out of stock
(b) We are unable to authorize payment for the order
(c) An error in the item information, including pricing or promotion details

1.27 By purchasing goods using a credit, debit card or Paypal you are confirming that the card being used is yours and that you have no objections to us performing any authorization checks which we deem necessary.
Products
1.28 We have made every effort to accurately represent the information and colours of products on this web site. However, as colours vary between different monitors, we cannot guarantee that your monitors display will accurately reflect the actual product colours or size.
1.29 All sizes and measurements are approximate and we advise customers to consult the sizing charts when ordering as fittings may vary, especially between different brands and types.
Delivery
1.30 UK delivery (including the Channel Islands) for all products from backtothetoyz.co.uk usually takes 2-5 working days from date of posting. this will be with Royal Mail or another courier of our choosing. We only deliver this way to the UK, Please contact us first for international Delivery.
1.31 For security reason we can only send items by Recorded mail, to the billing address of your account these will require a signature on delivery. Any subsequent delivery attempts or refusal is the responsibility of the customer and as such all charges incurred by. Please note that we will need to wait 21 Days from dispatch before we can investigate the non-arrival of an item.
1.32 The responsibility for the goods transfers to the customer upon delivery, except in cases where the products received are damaged or the incorrect products have been delivered by us. Liability for items which are lost or damaged after delivery will belong solely to the customer. Ownership of the products will pass to the customer on delivery of goods or upon receipt of full payment (including postage costs) being received by us, whichever is the later.
1.33 In the event of a non delivery and return of the goods to us, the items will be refunded minus any costs incurred such as but not limited to the original delivery costs, fees, and packaging. The items will then need to be repurchased if they are still required.
Promotions
1.33 Certain items on the backtothetoyz.co.uk web site may be available as part of promotional offers. Back To The Toyz reserves the right to modify, alter, discontinue or terminate such promotions at any time for any reason whatsoever without notice to end users.
Returns
1.34 Goods can be returned to us, in saleable condition, for a refund within 7 working days of receipt, for the following reasons
(a) If product is faulty.
(b) If the wrong item has been dispatched.
(c) If you have ordered the wrong colour or size. Postage will not be refunded and any additional carrier costs to Backtothetoyz.co.uk will be deducted from the refund value.
(d) If you do not like the product that you ordered. Postage will not be refunded and any additional carrier costs to backtothetoyz.co.uk will be deducted from the refund value.
1.34 If an incorrect item is sent by backtothetoyz.co.uk, it will be replaced only if it is returned to Back To The Toyz within 7 working days of receipt. Exchanges cannot be made for any collectable sealed items that have been opened, these items referred to as MOC/MIB/Carded Figures are sold as Collectibles and not as Toys to be opened and by purchasing them you (the customer) are agreeing that the intended use is for display purposes only. if you wish to open the items you do so at your own discretion but please be aware that this may affect the return policy unless the item is faulty or incorrect.
1.35 If the item is found to have been opened or damaged the final amount refunded may be reduced by the value of which the item has been decreased. The item purchase is as collectibles for display purposes only and not for play. At no point unless stated do we recommend the items for sale on this site are 'toys for play', and are for display only.
1.36 Please note that we currently can not offer an exchange for an item and can only issue a refund by the same way as payment was taken i.e.. Paypal. if you have ordered the wrong item please contact us and we may be able to arrange for you to purchase the right item providing it is in stock.
(Please note that MOC/Carded Figures are sold as collectable display only and are not sold as Toys, there for if they are opened this may effect the process in the refund policy for that item)
1.37 if you wish to return an item please do so by following the instructions found on the returns page. The statutory rights of the consumer are not affected by the terms of our service
1.38 Under the Distance Selling Regulations you have the right to cancel your order within 7 days of purchase for a full refund. To cancel an order you must inform us in writing (email, fax or post) within 7 days of purchase and return the item(s) to us. You should take reasonable care of the items while they are in your possession and you will need to return the cancelled order to us in the same intended purpose of the product in which it was sold to you. We will refund you on receipt of the goods or in 30 days whichever is the soonest. If we do not receive the cancelled order back we may arrange to collect it at your cost or the amount may again be charged.
1.39 If the item you wish refunded was purchased as part of a multi-buy promotion (such as 2 for £30, at £15 each, when originally priced £20 each etc.) you will be refunded the promotion amount and all other items will revert back to there original amounts.(e.g.. £10 will be refunded if 1 item was returned in the 2 for £30 at £20 original price.).

1.42 All official documentation is to be sent to our office. There is No Stock, Cash, or Personal Information held at this address and is only used for contact address. All items are dispatched from our warehouse and have no connections to this address. Personal information will be held at our offices, and for the purposes of processing payment (and maintaining records of the same) may be transferred outside the European Economic Area.

1.43 If you opt to receive offers by email, then we will automatically alert you to our latest offers and promotions whilst keeping you informed when we are in sale and when new brands arrive in stock.
1.44 All registered users and newsletter subscribers have the opportunity to unsubscribe at any time by following the unsubscribe link contained within all such emails.
1.45 Your email address will also be used to confirm when an order has been received and to update you on the progress of your order. We may also contact you via phone, mail or SMS if we feel this is necessary.

These terms and conditions are governed by English law. Any dispute arising in connection with these terms and conditions shall be subject to the exclusive jurisdiction of the Courts of England and Wales.
